The Right of Children to Free and Compulsory Education Act 2009, passed by Parliament received the assent of the President on 26th August, 2009. This Act provides for free and compulsory education to all children from the age of 6-14 years till elementary education. This Act bars any school or person from collecting any capitation fee and putting the student to any kind of screening procedure. The punishment for collecting capitation fee could be as high as ten times the capitation amount charged and Rs 25,000 for the first violation of the screening test provision and Rs 50,000 for each subsequent violation.
Every school, be it private or government-owned, is required to reserve 25% of the total seats in a class for children belonging to economically weaker groups. Though private schools have been trying to bypass these provisions, the government is determined to ensure full compliance with the law.
